Abstract

Legal protection for consumers who become victims of personal data misuse in e-commerce is divided into two types: Preventive and Repressive. Preventive legal protection is provided by the government to prevent violations before they occur. Repressive legal protection is provided to consumers after a violation or misuse of personal data has occurred. These legal remedies are divided into non-litigation (outside the court) and litigation (through the court). Non-litigation legal remedies include filing complaints with business actors or platforms, complaints with the Ministry of Communication and Information Technology (Kominfo), complaints with the Personal Data Supervisory Agency (LPDP), complaints with the National Consumer Protection Agency (BPKN), and dispute resolution with the Consumer Dispute Resolution Agency (BPSK). Litigation legal remedies include civil lawsuits (for unlawful acts), criminal reports to the police, and class actions.
