PERLINDUNGAN HUKUM TERHADAP PEKERJA PEREMPUAN PADA SHIFT MALAM DI INDOMARET DISTRIK JAYAPURA SELATAN DITINJAU DARI PERUNDANG-UNDANGAN

Abstract

This study, entitled "Legal Protection for Female Night Shift Workers at Indomaret in South Jayapura District, as Perspective of Legislation," aims to analyze the legal protection provided and company responsibilities for female night shift workers at Indomaret in South Jayapura District, as Perspective of Legislation.

This study employed qualitative methods, including normative research and empirical research based on a survey study, conducted at four Indomaret outlets in South Jayapura District. To obtain data, this study combined three data collection methods: observation, interviews with informants, and documentation relevant to the research object. Data analysis was conducted qualitatively, encompassing the stages of data collection, classification, and presentation, leading to descriptive conclusions.

The results indicate that legal protection has been implemented in several aspects, such as mixed-shift arrangements and the provision of CCTV surveillance systems. However, other protections, such as the provision of nutritious food and beverages, transportation facilities, and workers' rights training, have not been optimally implemented. Corporate responsibilities still focus on administrative aspects, such as BPJS Kesehatan (Healthcare and Employment) membership, without being balanced by the fulfillment of comprehensive substantive responsibilities. Therefore, improved policies and oversight are needed to ensure companies are more focused on the welfare and safety of female workers.
